AZ GOP backs House Republicans’ defense of birth-certificate law after AG declines appeal

The Arizona Republican Party has declared its support for House Republicans’ efforts to uphold the state’s birth-certificate law. This announcement follows Attorney General Kris Mayes’ decision not to appeal a federal ruling that permits sex-marker changes on birth certificates with only a doctor’s note. The GOP’s statement was made public on the social media platform X.

According to AZCentral, the recent federal ruling overturned parts of Arizona’s birth-certificate law, allowing individuals to amend their sex marker with a physician’s statement instead of proof of surgical transition. This decision reversed longstanding legal precedents regarding the state’s vital records, leading Republican lawmakers to commit to appealing the ruling in the Ninth Circuit Court of Appeals. The Arizona GOP said on X that “Arizona’s laws are not optional” and expressed their intention to defend statutory integrity in light of Attorney General Mayes’ inaction.

House Speaker Steve Montenegro confirmed, as reported by The Arizona Republic, that Republican leadership has filed notice seeking a stay on the federal decision while starting the appellate process. Montenegro said that the ruling “erases decades of statute and undermines the integrity of vital records.” The case focuses on state legislative authority over vital statistics and gender designation, potentially affecting similar laws in other states. Analysts suggest that the case could reach the Ninth Circuit by early 2026, depending on judicial scheduling.

Attorney General Kris Mayes, according to KJZZ News, said her decision not to appeal was based on her interpretation of constitutional protections for transgender residents. In response, the Arizona GOP argued that Mayes’ refusal signifies a failure to defend existing law, asserting that “if the Attorney General won’t defend Arizona’s laws, we will.” Legal experts informed KJZZ that this case might set a precedent for how far state legislatures can intervene when executive officials choose not to act.
