Tom Horne has responded to criticism from the Attorney General regarding the management of the Empowerment Scholarship Account (ESA) program. In a statement, Horne addressed concerns about fraud within the program and his department's actions.

"When my department found fraud in the ESA program, we sent the case to the Attorney General for prosecution," Horne stated. He further criticized Attorney General Mayes by saying, "Mayes is so incompetent that someone who should have been convicted was acquitted."

Horne highlighted the resources allocated by his department towards education, noting, "Our department has more than 600 people who do nothing but work on education." He contrasted this with what he perceives as a lack of focus from other governmental offices: "The Governor’s office has perhaps 3 or 4 people, but Mayes’ office has zero."
