Fann subjected to motion to intervene over Republican electors

A motion to intervene was filed by Maricopa County in a case in Arizona Superior Court against Senate President Karen Fann (R-Prescott). 

“Plaintiffs’ Complaint recognizes that the Republican Electors have an obvious interest in any investigation into whether they were improperly deprived of recognition as Arizona’s true electors, especially one which may lead to further legislative action on their behalf at either at the state or federal level,” the motion states. “The only way the Republican Electors can protect this interest is by helping to ensure that the state legislature gets all of the information it needs to conduct a full and thorough investigation.”

The intervenors are members of the Arizona Republican Party, incoming and outgoing Arizona lawmakers and plaintiffs in election-related litigation. 

The intervenors claim the complaint says it's illegal for the defendants to disclose certain public records that they have historically made available to Republican Party officials and other election officials and candidates in the past to help them register voters and target political advertising.

“Accordingly, Intervenors have an interest ensuring that they continue to have access to this information,” the motion states. “An adverse ruling now, if upheld on appeal, could establish precedent that could prevent them from gaining access to such information during future election cycles.”

The motion claims that public records are typically always available upon request to Arizona citizens and because of that, all of the intervenors have an interest in the public records law.

Allowing the intervenors to intervene in the case will not encumber the disposition of the case and will not impede the case, the motion states.

The intervenors include Republicans Tyler Bowyer, Nancy Cottle, Jake Hoffman, Anthony Kern, Christopher King, James Lamon, Sam Moorhead, Robert Montgomery, Lorraine Pellegrino, Greg Safsten, Salvatore Luke Scarmado, Kelli Ward, Michael Ward and Michael John Burke.
