The Arizona Supreme Court has dismissed Staci Burk’s appeal to decertify President-elect Joe Biden’s win in Arizona.
Burk’s complaint is one of the eight lawsuits that have been filed to challenge Biden’s win over Trump, in Arizona. The win was a result of Biden’s more than 10,000 votes over Trump’s.
Staci Burk, an appellant from Pinal County, who has represented herself in the court, although she isn’t a lawyer, has been identified to be an unqualified elector under A.R.S. § 16 121(A), one reason why she lacked the standing to challenge the election.
“There is nothing before the Court to indicate that Appellant timely contacted the appropriate authorities to correct any problems with her voter registration. An election challenge under A.R.S. §16-672 is not the proper vehicle to reinstate voter registration,” the Decision Order stated.
Additionally, Burk filed her complaint after the five-day filing period had passed.
The Decision further stated that “Here, the canvass was completed and declared on November 30, 2020; the five-day deadline expired on Saturday, December 5, 2020, and a statutorily compliant contest, therefore, needed to be filed no later than Monday, December 7, 2020. Although Appellant filed her contest on December 7, it was not verified by the Appellant’s affidavit.”
The Decision was signed by Chief Justice Robert Brutinel and was released on Jan. 5.
