The Arizona Legislature, led by Republicans, has passed the Secure the Border Act, also known as HCR 2060. This legislation aims to empower local, county, and state law enforcement to arrest individuals who are non-U.S. citizens entering Arizona from Mexico outside of lawful ports of entry. The act will be put to a vote in November.
The bill mirrors Texas' SB 4, which is currently under federal court review. If upheld and supported by Arizona voters, the act would take effect in Arizona 60 days after implementation in Texas.
Other provisions of the bill include increased penalties for drug dealers trafficking fentanyl resulting in overdose deaths and the establishment of state crimes for individuals living illegally in Arizona who submit false information for government benefits or employment. Additionally, it mandates state agencies to use the federal Systematic Alien Verification for Entitlements program alongside existing state verification systems when determining eligibility for non-U.S. citizens.
Senate President Warren Petersen stated, "In the 12 years I've served here at the Arizona Legislature, never has the border crisis been as dangerously severe as it is now, costing Arizona taxpayers more than $3 billion in 2023 alone." He criticized President Joe Biden's handling of border security: "As soon as Joe Biden took office, he rolled out the welcome mat for illegal crossings and criminal activity."
Senator Janae Shamp expressed her support for the act: "With every veto and with every 'no' vote against our border security bills, the Governor and Arizona Democrat Legislators have neglected the safety of our citizens." She added that she believes the Secure the Border Act will save lives and taxpayer dollars while strengthening national security.
Senator David Gowan emphasized concerns over international threats: "The cartels have teamed up with our country's biggest enemies... they are determined to destroy America." He noted that recent executive orders by President Biden exacerbate these issues: "With Joe Biden's latest executive order allowing 2500 illegals into our country per day... it's up to everyday Arizonans to stop the lawlessness."
