Electric vehicles face losing access to Arizona HOV lanes under federal change

The Federal Highway Administration has notified Arizona about a pending change that could impact the use of high-occupancy vehicle (HOV) lanes by certain vehicles. According to this notification, unless there is intervention at the federal level, electric vehicles and other eligible alternative fuel vehicles with single occupants may lose their access to HOV lanes during peak times starting September 30, 2025.

To assist vehicle owners in preparing for this change, the Arizona Department of Transportation (ADOT) has launched a website at azdot.gov/HOVRule, which provides detailed information about the impending transition. This includes the expiration of a current federal provision that permits these vehicles to use HOV lanes.

The Federal provision, specifically 23 USC 166b, currently allows Arizona to exempt alternative fuel vehicles, including those powered by electricity, natural gas, propane, hydrogen, and certain alcohols, from occupancy restrictions in HOV lanes. However, this provision might expire if Congress decides against renewing it.

ADOT is proactive in disseminating this information due to its significant impact on Phoenix-area travelers, alternative fuel vehicle owners, and businesses involved in selling and servicing these types of vehicles. ADOT's Motor Vehicle Division is taking steps to inform auto dealers so they can relay the information to their customers.

ADOT has also set up a resource at azdot.gov/HOV that explains the purpose of HOV lanes, eligibility criteria, and provides answers to frequently asked questions.
